Government Decree No. 41/2020 (11 March)
on measures to be taken in the state of emergency ordered to prevent a human epidemic causing mass illness threatening the safety of life and property, and to mitigate its consequences, and to protect the health and lives of Hungarian citizens

Pursuant to the powers conferred under paragraph 4 (c) of Section 16 of Act LXXXIX of 2007 on the state border,

with regard to subheading 2 and subheading 3, acting under the original legislative power conferred by paragraph (2) of Article 53 of the Fundamental Law and under the scope of the duties specified in paragraph (1) of Article 15 of the Fundamental Law,

the Government orders the following:

1. The temporary restoration of border control on the border of Hungary and the Republic of Slovenia, and on the border of Hungary and the Republic of Austria

Section 1 The Government, pursuant to paragraph (1) of Article 28 of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders, shall temporarily restore border control on the border of Hungary and the Republic of Slovenia, and on the border of Hungary and the Republic of Austria.

2. Rules on epidemiological isolation, observation, containment and control ordered to prevent the introduction or spread of a communicable disease subject to a containment obligation

Section 2 (1) The vehicles below engaged in international passenger carriage arriving from the Republic of Italy, the People’s Republic of China, the Republic of Korea, and the Islamic Republic of Iran may not enter the territory of Hungary:

  • railway vehicles,
    buses and/or coaches, and
    civilian aircraft, with the exception of aircraft crossing Hungary without landing.

(2) Non-Hungarian citizens arriving from the Republic of Italy, the People’s Republic of China, the Republic of Korea, and the Islamic Republic of Iran in passenger traffic may not enter the territory of Hungary.

Section 3 (1) Hungarian citizens arriving from the Republic of Italy, the People’s Republic of China, the Republic of Korea, and the Islamic Republic of Iran

will undergo a medical check on entering Hungary which they are obliged to tolerate,
any person who the medical check establishes to be suspected of being infected with the COVID-19 virus shall be placed in designated quarantine,

c)       any person who the medical check establishes not to be suspected of being infected with the COVID-19 virus shall subject themself to epidemiological observation for 14 days at home in their permanent or temporary place of residence (hereinafter referred to as “official house quarantine”) on condition that

ca)     such persons are entered in the register of the designated epidemiological authority,

cb)     compliance with the rules of official house quarantine is checked by the body established to provide general policing duties (hereinafter referred to as the “police”),

any person who the medical check establishes not to be suspected of being infected with the COVID-19 virus and who does not have a permanent or temporary place of residence in Hungary shall

da)    leave the territory of Hungary in compliance with the regulations of the authorities, or

db)    be placed in designated quarantine.

(2) The provision and care of persons placed in official house quarantine in accordance with paragraph (1) (c) and (d) is the responsibility of the mayor of the municipality.

Section 4   From the entry into force of this decree

expiring official documents of Hungarian citizens effective in the territory of Hungary will be valid for 15 days after the cessation of the state of emergency,
visits by students to higher education institutions are forbidden,
in the interest of coordinated protection, no extraordinary holiday in public education institutions may be ordered by the head of the institution, the district clerk or the Education Authority,
holding events attended by more than 100 people in an enclosed space and more than 500 people in an unenclosed space is forbidden, with the proviso that enforcing this restriction is the liability of the organiser and the operator of the venue,
the International Language Learning Programme is suspended,
school excursions abroad are forbidden, and school excursions abroad which have already been booked shall be cancelled.

Section 5 Non-Hungarian citizens who break the rules on epidemiological isolation, observation, containment and control ordered to prevent the introduction or spread of the communicable disease subject to a containment obligation set out in Section 2 – infringing paragraph (1) of Section 361 of Act C of 2012 on the Criminal Code – will be expelled and deported from the territory of Hungary.

3. Extraordinary measures

Section 6 (1) From the entry into force of this decree

health professionals pursuant to Act CLIV of 1997 on healthcare,
professional, contracted soldiers and volunteer reserve soldiers performing actual military service pursuant to Act CCV of 2012 on the service status of members of the Hungarian Defence Forces,
defence employees pursuant to Act CXIV of 2018 on the service status of members of defence employees,
persons with professional service status and employees of the law enforcement agencies pursuant to Act XLII of 2015 on the service status of professional members of law enforcement agencies,
employees pursuant to Act CXXII of 2010 on the National Tax and Customs Administration, and
government officials pursuant to Act CXXV of 2018 on government administration

may only leave the territory of Hungary with the special permission of the minister responsible for the sector.

(2) From the entry into force of this decree, foreign missions for ministries and the Government Office of the Prime Minister may only be ordered by special permission of the minister or the prime minister.

(3) Permission in accordance with paragraphs (1) and (2) may also be granted for specified groups of employees.

Section 7 (1) The Hungarian Defence Forces – in view of the statutory provisions – shall cooperate in implementing law enforcement measures related to the emergency, and support the police and the professional disaster relief agency in the performance of their specialist duties.

(2) The Health Protection Institutes of the Hungarian Defence Forces’ Health Centre shall, in cooperation with the NATO Centre of Excellence for Military Medicine, continually send proposals for measures to the head of the Operational Group for Protection Against the Coronavirus Epidemic.

Section 8 EEA citizens who are entitled to reside permanently in Hungary and who can verify this right with a permanent residence card shall be treated in the same manner as Hungarian citizens.

4. Final provisions

Section 9 This decree shall enter into force on the day after its publication.

Section 10 Powers shall be granted to

a)       the minister without portfolio responsible for the management of national assets to lay down special rules guaranteeing the operability of state-owned companies forming part of vital infrastructure,

b)      the minister with responsibility and competence to suspend international mobility programmes under his responsibility and competence.
